COPYRIGHT POLICY

Buzzmusiq respects other people’s rights and we expect you to do the same.

Since we respect artist and content owner rights, it is Buzzmusiq’s policy to respond to alleged infringement notices that comply with the Digital Millennium Copyright Act of 1998 (“DMCA").

  1. Account Suspension or Termination

In accordance with the DMCA and other applicable law, Buzzmusiq has adopted a policy of terminating, in appropriate circumstances, Users who are deemed to be repeat infringers. Buzzmusiq may also at its sole discretion limit access to the App and/or terminate the accounts of any Users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

  1. Copyright Infringement Notification

If you believe that your copyright-protected work was posted on Buzzmusiq’s site or app, or otherwise hosted by Buzzmusiq, without authorization, please notify Buzzmusiq as set forth below. For your complaint to be valid under the DMCA, you must provide the following information in writing:

All information submitted in your copyright infringement notification may be forwarded to the poster of the content, to chillingeffects.org, or otherwise made public in any way by Buzzmusiq or a third-party.

UNDER FEDERAL LAW, IF YOU KNOWINGLY MISREPRESENT THAT ONLINE MATERIAL IS INFRINGING, YOU MAY BE SUBJECT TO CRIMINAL PROSECUTION FOR PERJURY AND CIVIL PENALTIES, INCLUDING MONETARY DAMAGES, COURT COSTS, AND ATTORNEYS’ FEES.

Please note that this procedure is exclusively for notifying Buzzmusiq and its affiliates that your copyrighted material has been infringed. The preceding requirements are intended to comply with Buzzmusiq’s rights and obligations under the DMCA, including 17 U.S.C. §512(c), but do not constitute legal advice. It may be advisable to contact an attorney regarding your rights and obligations under the DMCA and other applicable laws.

  1. Copyright Infringement Counter-Notification

If you receive a copyright infringement notification that you believe to be in error, you may provide us with a counter-notification. It must include the following:

  1. Your contact information, including your full legal name (not that of a company), an email address, a physical address, and a phone number. If you are an authorized representative of the uploader, such as an attorney, please be sure to specify your relationship to the uploader.
  2. Identify the location, including any URL, of the work that has been removed or disabled.
  3. You must agree to and include the following statement: "I consent to the jurisdiction of the Federal District Court for the district in which my address is located, or if my address is outside of the United States, the judicial district in which Buzzmusiq is located, and will accept service of process from the claimant." Buzzmusiq is located in the Southern District of California.
  4. And the following statement: "I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled."
  5. The physical or electronic signature of the copyright owner or an authorized representative of the copyright owner. To satisfy this requirement, you may type your full legal name (not that of a company) at the bottom of your electronic counter-notification.

The counter-notification process may take up to 10 business days to complete, so please be patient. During this time, the copyright claimant may file an action seeking a court order to keep the content down. Please note that we will forward the entire counter notice to the copyright claimant, including any personal information you provide, and the counter notice may be made public. The claimant may use this information to file a lawsuit against you.

The decision to re-post any material is at Buzzmusiq’s sole discretion.
